- Freedom of religion or belief (FoRB) enjoys the reputation of a classical human right, broadly endorsed internationally and deeply entrenched in legally binding conventions – or so it might seem. At the same time, however, FoRB is exposed to numerous misunderstandings, which often obfuscate its emancipatory and egalitarian spirit. Moreover, FoRB harbors an enormous provocative potential by challenging traditional religious hegemonies, by preventing the state from mingling with religious affairs, and by promoting diversity in the broad area of convictions and practices.
The seminar aims at a systematic understanding of FoRB, within the broader human rights framework. Based on General Comment no. 22 of the UN Human Rights Committee, we will first unpack the systematic implications of this particular right. Subsequently, we will discuss possible tensions between FoRB and other human rights issues, such as freedom of expression or gender equality. This will happen on the basis of recent jurisprudence at the international and the European level. We will furthermore try to identify the root causes of violations of FoRB in different countries and explore strategies for a more efficient implementation.
