Voraussetzungen / Organisatorisches
This level 3 course is part of the law and language certificate programme Fachsprache Jura.

The course may only be attended by those law students who have already satisfactorily completed the JAPO-Pflichtkurs Introduction to English Legal Language.

Registration is obligatory for this course (by 20th October 2017 at the latest) online via StudOn

ATTENDANCE
Regular attendance and active participation are required in order to successfully complete this course, therefore attendance is compulsory in accordance with the university guidelines. Your teacher will inform you in the first session about any compulsory tasks that need to completed during the course as a prerequisite for being admitted to the final exam, as well as the maximum number of classes you may miss. Please be aware that not all materials relevant for the exam will necessarily be posted on StudOn and that participants are responsible for making sure that they catch up on any missed classes, acquire any additional materials and complete and/or submit any compulsory tasks.

ASSESSMENT
There are three components to the assessment for this course:

  • A 60 minute written examination (60% of the final grade) which will take place on Saturday, 3rd February 2018 (time and room will be made known in the exam timetable which will be published shorty after the course starts and in mein campus)

  • A listening comprehension task (20%)+

  • A text production task (20%)+

+The listening and text production tasks will be made available via StudOn on Wednesday, 20th December and must be submitted - also via StudOn - by Sunday, 7th January at the latest.

Registration for the exam via mein campus is compulsory (registration period: Monday, 20th November (00:01) - Friday, 8th December (12:00)). The exam number is 30156.

REPEATING THE COURSE
We expect to offer this course again in the summer semester 2018. Students who fail the exam and wish to retake it may do so at the end of the next semester without having to retake the whole course, providing they obtain the grade 4,7. Students who fail with the grade 5,0 must retake the whole course before being allowed to attempt the exam again.

Inhalt
Private Law A covers three separate areas of private law: company and commercial law, intellectual property and competition law.

In company and commercial law you will look at the formation of companies, consider the differences between German, English and American corporate structures, learn and use company-related vocabulary and terminology, discover what commercial law encompasses and the laws which govern it, and consider when relevant legislation such as the Sale of Goods Act (UK), the Uniform Commercial Code (USA) and the the United Nations Convention on Contracts for the International Sale of Goods (CISG) come into play.

Intellectual property covers the various protection rights such as copyright, patents, design rights and trademarks. You will look at these in the context of the commercial areas which they influence and consider some of the issues surrounding the protection of these rights through legislation and case law.

Competition law deals with the objectives of legal protection and the different areas of regulation concerning anti-competitive behaviour, also considering the relationship which exists between competition and IP law. You will identify the legislative instruments used to regulate anti-competitive behaviour in various jurisdictions and learn and utilise the legal terminology associated with this field of law.

The course consists of 3 units:
1. Company & Commerical Law
2. Intellectual Propety
3. Competition Law

The course will place equal weighting on all the four language learning skills: reading, writing, listening and speaking.
